At the initiation of any action, administrative proceeding or special proceeding to abate a nuisance under this Chapter, the City may elect to seek recovery of its attorneys’ fees incurred in such action or proceeding. If the City so elects, then the prevailing party in such action or proceeding shall be entitled to recover its attorneys’ fees from the other party; provided, however, that in no event shall any prevailing party be entitled to recover an amount of attorneys’ fees which exceeds the amount of reasonable attorneys’ fees which the City has incurred in the action or proceeding.
